By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Eric Lunstead and Nichole Beyer to Mortgage Electronic Registration Systems, Inc. acting solely as a nominee for Countrywide Bank, FSB, dated March 23, 2009 and recorded in Middlesex County (Southern District) Registry of Deeds in Book 52597, Page 344 (the “Mortgage”), as affected by a Loan Modification Agreement dated April 17, 2012 and recorded at said Registry of Deeds in Book 61330, Page 510, and as further affected by a Loan Modification Agreement dated April 17, 2012 and recorded at said Registry of Deeds in Book 61873, Page 522 of which mortgage Bank of America, N.A., successor by merger to BAC Home Loans Servicing, LP f/k/a Countrywide Home Loans Servicing, LP is the present holder by assignment from Mortgage Electronic Registration Systems, Inc. to Bank of America, N.A., successor by merger to BAC Home Loans Servicing, LP f/k/a Countrywide Home Loans Servicing, LP dated October 25, 2011 recorded at Middlesex County (Southern District) Registry of Deeds in Book 57871, Page 450, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 81 Hill Road, Groton, MA 01450 will be sold at a Public Auction at1:00 PM on January 8, 2018, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
The land with the buildings thereon, situated on the southerly side of Hill Road in Groton, Middlesex County, Massachusetts and being shown as Lot 4 on a plan of Land entitled: “Plan of Land, Groton, Mass., prepared for J & C Homes, Inc., owned by John D. and Mary P. Allen, dated April 27, 1976, Amherst Survey Associates, Inc.” which plan is recorded with the Middlesex South District Registry of Deeds as Plan Number 985 of 1976, Book 13052, Page 419, and thus bounded and described:
Northerly by said Hill Road in two courses, 9.00 feet and 31.00 feet, respectively;
Easterly by Lot 3 as shown on said plan, 226.29 feet;
Northerly by Lot 3 as shown on said plan, 183.44 feet;
Easterly by Lot 2 as shown on said plan, 1132.42 feet; and
Southerly by Lot 18 as shown on said plan, 255.00 feet;
Westerly by Lot 6 and Lot 5 as shown on said plan, 1109.94 feet.
Containing 5.093 acres according to said plan.
Subject to a variance recorded with the said Registry of Deeds, in Book 13052, Page 418.
For mortgagor’s title see deed recorded with the Middlesex County (Southern District) Registry of Deeds in Book 50808, Page 139.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cash, cashier’s or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable in cash or by certified check in thirty (30) days from the date of the sale at the offices of mortgagee’s attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA 01851 or such other time as may be designated by mortgagee.
