Public Auction of House on Valley Road

NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE

    By virtue and in execution of the Power of Sale contained in a certain mortgage given by Lyle E. Hamerla and Terri Ann Hamerla to IndyMac Bank, F.S.B., dated June 27, 2002 and recorded with the Middlesex County (Southern District)  Registry of Deeds at Book 35781, Page 291, of which mortgage the undersigned is the present holder by assignment from  IndyMac Bank, F.S.B. to  Countrywide Home Loans, Inc. dated  December 18, 2002 and recorded with said registry on  September 20, 2003 at Book  40592 Page  81 and  by assignment from  (corrective) Countrywide Home Loans, Inc. to  Federal National Mortgage Association dated  November 13, 2013 and recorded with said registry on  January 29, 2014 at Book  63226 Page  457, for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at12:00 p.m. on November 16, 2017, on the mortgaged premises located at 53 Valley Road, Groton, Middlesex County, Massachusetts, all and singular the premises described in said mortgage,

    TO WIT:

     The land in said Groton, Middlesex County, Massachusetts, with the buildings thereon situated on Valley Road, and being shown as Lots 26096, 26097, 26098, 26099 and 26100 on plan entitled ‘’Map Two, Lost Lake, Town of Groton, Middlesex County, Massachusetts, Shay & Leary, Engineers 1925’’, said plan being recorded as No. 844 of 1925 in Middlesex South District Registry of Deeds; and to which plan reference may be had for a more particular description of the premises.

     Being the same premises conveyed to the mortgagors by deed of Mary J. Furlong dated September 21, 1982 and recorded with said Deeds in Book 14744, Page 19.

    Also, the land in said Groton, Middlesex County, Massachusetts, being shown as Lots #26089 and 26090 on a plan entitled ‘’Map Two, Lost Lake, Town of Groton, Middlesex County, Massachusetts, Shay & Leary, Engineers 1925’’, said plan being recorded as No. 844 of 1925, in Middlesex South District Registry of Deeds; and to which plan reference may be hand for a more particular description of the premises.

     Also, the land in Groton, Middlesex County, Massachusetts, and being Lots 26091, 26092, 26093, 26094 and 26095, as shown on a plan entitled ‘’Map Two, Lost Lake, Town of Groton, Middlesex County, Massachusetts, Shay & Leary, Engineers 1925’’ said plan being recorded as No. 844 of 1925 in Middlesex South District Registry of Deeds; and to which plan reference may be had for a more particular description of the premises.

    The above described premises are conveyed subject to and with the benefit of all easements, privileges and restrictions of record insofar as the same may now be in force and applicable.

    For mortgagor’s(s’) title see deed recorded with Middlesex County (Southern District) Registry of Deeds in Book 35781, Page 289.

   These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.

    TERMS OF SALE:

    A deposit of Five Thousand ($5,000.00 ) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale.  The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California Street, Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale.  Deed will be provided to purchaser for recording upon receipt in full of the purchase price.  The description of the premises contained in said mortgage shall control in the event of an error in this publication.
