To the above-named Third-Party Defendant: Relax and Rejuvenate Spa Solutions
You are hereby notified that a Third-Party Complaint has been filed by the above named Defendant/Third-Party Plaintiff, Kimpton Group Holding, LLC, in which you are named as a Third-Party Defendant and in which Kimpton Group Holding, LLC seeks indemnification. This Complaint may be examined at the Suffolk Superior Court, or a copy may be obtained from the Third-Party Plaintiff’s attorney. If you intend to make any defense, you are hereby required to serve upon the Third-Party Plaintiff’s attorney, Paul F. Lynch, Esq. of the Law Offices of Sherry, Geller, Cain & Vachereau, whose address is 10 Saint James Avenue, 5th Floor, Boston, MA 02116, an answer to the Third-Party Complaint which is herewith served upon you, within 20 days after service of this summons, exclusive of the day of service. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Third-Party Complaint. You are also required to file your answer to the Third-Party Complaint in the office of the clerk of the Suffolk Superior Court either before or upon service to the Third-Party Plaintiff’s attorney.
Unless otherwise provided by Rule 13(a), your answer must state as a counterclaim any claim which you may have against the Third-Party Plaintiff which arises out of the transaction or occurrence that is the subject matter of the Third-Party Plaintiff’s claim or you will thereafter be barred from making such claim in any other action.
