Discharge of Water Onto Public Way Could Incur $300 Fine Per Day

  Following a vote of Town Meeting residents will now be subject to notices of violation if they discharge water from their property onto a public way.  Failure to correct the discharge issue within 30 days of notification is then subject to enforcement action.

   Discharge of water includes the man-made diversion or back up of water onto a public roadway or sidewalk of the Town by pump, downspout, swale, grading or land or other method, so as to create a hazard to vehicle or pedestrian travel.

   As an alternative to civil prosecution, the Director of Public Works or any Police Officer may elect to enforce the by-law by utilizing the non-criminal procedure set forth in Mass General Law. The fine for each non-criminal violation is $300 and each day or a portion of a day on which the violation exists will constitute a separate offense.
